Useful tips before buying a land or property
Before drafting the public deed of sale, a private contract is usually signed between the buyer and the seller. The private document is not mandatory or registrable, but the law considers it a valid contract and requires compliance with everything it contains.
Therefore, if you are buying a house in Gaza or elsewhere, it is important to seek proper advice before signing anything. Some important issues must be considered when writing the private document:
Who signs for the seller? When a developer sells, the administrator or the company's attorney signs. If it is a sale between individuals, all owners must sign, and if it is a community or family home, both spouses must sign.
Status of liens on the property. It is essential to check whether the property is free of liens, whether it has a mortgage, whether there are any liens against it, or whether there are any limitations in the bylaws of the homeowners' association.
You can request a simple informative note directly from the Property Registry or do so Sometimes you need to request a certificate of urban planning legality from the city council in case there is any type of encumbrance not recorded in the Property Registry.
Before purchasing, make sure the property is up to date with payments and expenses, as in certain cases the law requires the buyer to be responsible for them.
Clearly determine the price and payment method. Do not allow a lower price than the actual price or pay amounts that are not documented. This is against the law and can be detrimental to you.
When signing the private contract, a deposit is usually given as part of the total price, or "deposit," known as "deposit," which binds both parties. The most common are "penitential" deposits, which allow the buyer to withdraw from the contract before signing the deed. If the buyer cancels the agreement, they will lose the amount paid, while if the seller cancels the agreement, they will have to return double the amount received.
